KABALIKAT, Inc. - A Registered SECTORAL ORGANIZATION

 

The Karapatan sa Batas at Lipunang may Katarungan, Inc. (“KABALIKAT”) is a sectoral organization composed of individuals bound together by similar attributes or characteristics, or by shared and common interests or relations – that is, an aggregation of persons who are victims or sufferers of the “social and criminal injustice” system, especially those persons deprived of liberty (PDLs) and others similarly situated, as well as their families and relatives.

 

KABALIKAT firmly believes in the truism that all men are born free and equal before the law”. That, an injustice to one, is an injustice to all” (“Ang Kulang na Katarungan sa Isa ay Kulang na Katarungan sa Lahat”).

 

As such, KABALIKAT is a marginalized and totally unrepresented sector  of  the  national society that lacked a well-defined  political  constituency but who could contribute to the formulation and enactment of appropriate social and crime legislation that will benefit the nation as a whole.

 

THEREFORE, KABALIKAT is created conformably with the State’s declaration of policy and the law to encourage non-governmental, community-based, or sectoral organization that promotes the welfare of the nation, and it shall act as the exclusive sectoral organization of its qualified members through the party-list system for the purpose of their proportional representation in the election of representatives to the House of Representatives. 

 

Under SEC Company Registration No. CN 201311695, thusly, was born KABALIKAT, INC. on the 20th June 2013. 

 

To date, KABALIKAT, more or less, has twenty thousand (20,000) members and counting.

KABALIKAT has finally filed its Petition for Registration as PARTY-LIST with the COMELEC on May 7, 2015 for the national elections in May 2016.

 

 It was docketed as PP 15-060 (PL) with SPP 15-094 (PLM)

KABALIKAT filed petition for mandamus against DOJ and DILG for issuance of IRR (in re RA No.10592)

 

KABALIKAT, on February 18, 2014, filed Petition for Mandamus in the matter of the promulgation of the Implementing Rules and Regulations (“IRR”) of RA No. 10592 (“An Act amending Articles 29, 94, 97, 98, and 99 of Act No. 3815, as amended, otherwise known as the Revised Penal Code”). It was entitled “Karapatan sa Batas at Lipunang may Katarungan, Inc., petitioner, vs. DOJ, DILG, et. al.”, and docketed as R-QZN-14-01593-CV before the Regional Trial Court of Quezon City (Branch 216).

 

Subsequently, on the scheduled hearing on March 26, 2014, the DOJ and DILG issued the IRR based on the filing of such mandamus petition.  

 

KABALIKAT filed petition for declaratory relief in re validity and constitutionality of the "prospective application" of the IRR contrary to Article 22, Revised Penal Code, and the "equal protection" clause of the 1987 Constitution

 

While the DOJ and DILG, after the lapse of more than 300 days from the effectivity of the law or RA No.10592 on June 13, 2014, promulgated the IRR thereof, Section 4 of Rule 1 made the application thereof prospectively, which is contrary to Article 22, Revised Penal Code,  and the “equal protection” clause of the 1987 Constitution. Moreover, the clear intent of the said law – which was precisely to decongest detention centers and correctional facilities of persons deprived of liberty (PDLs) - was violated. Similarly, it is argued that the said IRR comes in the nature of an ex post facto law.

 

The same is now pending before the RTC of Quezon City (Branch 77) against the same respondents – DOJ and DILG. Its next scheduled hearing is on April 24, 2015.
